In Romania it is not allowed to possess psychoactive substances, as the quantity is not important for the investigation of a person caught with drugs on him. Thus, if those substances fit the pattern set out in Law no. 143/2000 and other legislation, the person will be criminally investigated.
Can I possess drugs?
As mentioned above, in Romania it is prohibited to possess psychoactive substances in any quantity. The only exceptions allowed to the law are medical ones and justified by documents issued by a medical specialist for certain substances.
There is no minimum or maximum quantity to differentiate between possession of drugs for consumption and drug trafficking, the relevant factor in making this distinction being the intention of the perpetrator.
Risks of possession of prohibited substances
The risks involved in the offences provided for by Law No 143/2000 are particular given the seriousness of these offences.
Even the offence of possession of drugs with a view to consumption can attract a significant penalty even if the quantity of psychoactive substances is small.
In order to minimise the risks to which those caught with drugs on them are exposed, they should adopt a strategy whereby they use all the rights available to them under the law to their advantage.
In some cases, a plea agreement can even be entered into to avoid a court case, a more serious sentence and additional costs.
